Illinois Law to Fix Pensions: Unconstitutional

 

News reports out of Springfield IL are stating that Illinois State Court Judge John Belz has ruled that the Illinois’ legislative fix to the State’s pension funding shortfall violates the State’s constitution.

The ruling held that a 1970 constitutional provision which states that public employee retirement benefits can’t be diminished has precedent over the State’s belief that it has sovereign power to trip future cost-of-living adjustments and delay retirement eligibility for some works.
